Wisconsin Statutes required the Department to write rules that would establish uniform statewide standards for nonmetallic mining reclamation. These exist as Chapter NR 135, Wisconsin Administrative Code, which became effective December 1, 2000.
The Department has developed additional support materials, including model ordinances for use/adoption by counties and interested municipal governments. The DNR will continue to provide technical assistance and training. In addition, the Department must perform program review audits to ensure that county and local ordinances are being fully and uniformly enforced in compliance with state law.
Philosophically, the Legislature intended that these programs and associated decision making be done in a way that favors local control. Local mine operators and citizens are better served by dealing with county or municipal government officials. They are more familiar with the area they are serving and with other local conditions than state agency officials would likely be.
