Model Reclamation Ordinances

All county and municipal jurisdictions, known as Regulatory Authorities (RAs), that administer nonmetallic mining reclamation programs are required to amend their ordinances by June 1, 2007. The revised ch. NR 135, Wis. Adm. Code, which became effective on December 1, 2006, also eliminates redundant program "startup" language and streamlines certain administrative procedures.

The DNR has prepared updated model ordinances to assist RAs with amending their reclamation ordinances. If you would like the model ordinances in electronic Microsoft Word format, please contact Thomas Portle.

RAs may enact their own version of a reclamation ordinance (that differs from either model) as long as the ordinance complies with the overall requirements of ch. NR 135. All program managers are encouraged to contact their board to allow ample time for scheduling the ordinance revision process.
