Beneficial Use of Industrial Byproducts

Clean Soil, Brick, Building Stone, Concrete, Broken Pavement, Unpainted and Untreated Wood, and Glass

Section 289.43(8)(b)1., Stats., allows the Department of Natural Resources to promulgate rules that need not be disposed of at a licensed solid waste disposal facility. Section NR 500.08, Wis. Adm. Code identifies certain solid wastes and specific conditions that qualify these wastes as exempt from the requirements of chs. NR 500 to 536, Wis. Adm. Code. In general these rules require that these wastes be disposed of in a licensed solid waste facility.

Section NR 500.08(2)(a) exempts clean soil, brick, building stone, concrete, broken pavement, and unpainted and untreated wood from the requirements of chs. NR 500 to 536, Wis. Adm. Code. These wastes when beneficially used in compliance with the locational requirements outlined in s. NR 500.08(2), Wis. Adm. Code are characterized as special wastes under s.895.58, Stats.

Section NR 500.08(2)(f), Wis. Adm. Code exempts glass, used as an aggregate replacement in asphalt pavement and subbase material under roadways, from the requirements of chs. NR 500 to 536, Wis. Adm. Code. This waste when beneficially used in compliance with the specific conditions outlined in s. NR 500.08(2)(f)1., 2., and 3., Wis. Adm. Code and the locational requirements in s. NR 500.08(2), Wis. Adm. Code are characterized as special wastes under s. 895.58, Stats.

The locational requirements referred to in s. NR 500.08(2), Wis. Adm. Code are found in s. NR 504.04(3) (c) and (4) (a) to (f), Wis. Adm. Code. These requirements, in general, establish a set of environmentally sensitive places where the use of exempt wastes cannot be placed.
