Land Recycling Loan Program

Section 677 of 2009 Wisconsin Act 28 of the 2009-2011 budget transfers the remaining loan funds of the Land Recycling Loan Program (LRLP) to the Dry Cleaner Environmental Response Fund (DERF). Therefore, the LRLP will no longer be accepting applications for remediation of brownfield sites.

The application deadline dates for the LRLP have been suspended due to the transfer of loan funds to the Dry Cleaners Environmental Fund.

The municipality (political subdivision) must submit the following items along with its application to the Bureau of Community Financial Assistance, when applicable to the project:

  • A completed financial assistance application form ( 2 copies--Form 8700-267).

  • Executed engineering contract(s) for environmental assessment, site investigation, or remedial action options report, if requesting funds to cover these activities.

  • A proposed or executed engineering contract for remediation.

  • An authorized representative resolution.

  • Financial information required by the Department of Administration, e.g. municipality’s current year budget, financial audit reports, information regarding outstanding bond issues, etc. This information is necessary in determining the affordability of the project and the financial capability of the municipality to repay the loan.   • Municipal agreements and/or contracts with private developers, if applicable.

  • Documentation applicable to IRS tax information.

  • A resolution declaring intent to reimburse municipal accounts with financial assistance proceeds as required by U.S. Treasury regulations. A copy of an executed reimbursement resolution must be included if funding from the LRLP will be directed to a municipal account. The municipality would be reimbursed for municipal funds previously spent on eligible project costs. The reimbursement resolution should be adopted and in effect before eligible costs are incurred.

Additional documentation, including evidence of an approved remedial action options report, is required before the project manager can prepare the financial assistance agreement. See financial assistance agreement and loan closing process for further information.

Prior to the financial assistance agreement preparation a Bond Counsel or an attorney experienced in Wisconsin municipal debt issuance is required to prepare the bond documents and the bond transcript for the loan. Evidence of qualifications, experience and liability insurance coverage may be required by the LRLP to demonstrate the acceptability of the counsel.
