A 39 year old, resident, female passenger was riding double on a single seat ATV. The operator attempted a 90 degree turn and rolled the ATV over. The passenger was thrown from the ATV and then the ATV rolled over her causing fatal injuries. The operator received minor injuries. The operator was arrested for causing death by intoxicated operation of a vehicle, operator BAC .214.

The ATV was found in a vertical position with the rear wheels in the air. The ATV was in reverse gear and in four-wheel-drive with the victim found face down in front of the ATV laying on top of his oxygen tank with his hand under the front left fender unable to move.

The victim was operating an ATV on private property with his 3 year old granddaughter in front of him. After traveling over a slight dip in the lawn, the ATV veered to the right and rolled over, ejected both subjects. The victim was not wearing a helmet and collided with a tree, inflicting major head trauma. The 3 year old passenger was wearing a helmet and was uninjured. The victim was transported to the hospital where he was pronounced dead.

The victim was operating an ATV on a public highway under the farm use allowances. The victim lost his hat while operating the ATV and was attempting to do a u-turn when he pulled into the path of the truck.
